Scan Secure Pay Terms and Conditions May 2023 These Terms and Conditions govern your use of the Scan Secure Pay mobile application ("App") provided by Scan Secure Limited. By accessing or using the Scan Secure Pay App, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the App. 1. Definitions** "App" refers to the Scan Secure Pay mobile application developed and provided by Scan Secure Limited. - "User" refers to any individual or entity that downloads, installs, or uses the Scan Secure Pay App. - "Services" refers to the features, functionalities, and capabilities offered by the Scan Secure Pay App. - "Payment Platform" refers to the technology infrastructure that enables Users to make secure payments through the Scan Secure Pay App. 2. User Eligibility 2.1. You must be at least 18 years old and capable of entering into a legelly binding agreement to use the platform. 2.2. By using the Platform, you represent and warrant that you jave the legal capacity to enter these Terms. 3. Account Registration 3.1. To use the Scan Secure Pay App and access the Services, you must create an account by providing accurate and complete information during the registration process. 3.2. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. 3.3. We reserve the right to suspend or terminate your account if we suspect any unauthorized activity or violation of these Terms. 4. Payment Processing 4.1. The Scan Secure Pay App allows Users to receive and make payments electronically to merchants, service providers, and other Users. 4.2. The Company acts as a facilitator and does not directly process or handle any financial transactions. The Company may partner with third-party payment processors to enable secure and efficient payment processing. 4.3. By using the Scan Secure Pay App for making payments, you authorize the Company to transmit your payment instructions to the relevant payment processor for execution. The Company shall not be liable for any delays, errors, or losses resulting from the payment processing activities of the payment processor. 4.4. We charge fees for certain transactions, which will be clearly disclosed before the transaction is processed. 4.5. Scan Secure Limited employs industry-standard security measures to protect your payment information; however, you acknowledge and agree that no security system is completely foolproof, and the Company cannot guarantee the absolute security of your payment data. 4.6. We also have the discretion to refuse or cancel any transaction that we reasonable suspect to be fraudulent. 5. User Responsibilities** 5.1. You agree to use the Scan Secure Pay App and Services in compliance with all applicable laws, regulations, and these Terms and Conditions. 5.2. You shall not engage in any fraudulent, deceptive, or abusive behaviour while using the Platform. 5.3. You shall not interfere with or disrupt the Platform or its associated systems, including but not limited to introducing viruses, malware, or any other harmful code. 5.4. You are solely responsible for any content, information, or materials you provide through the Scan Secure Pay App. You represent and warrant that you have the necessary rights and permissions to share such content. 5.5. You shall not engage in any activities that may compromise the security or integrity of the Scan Secure Pay App, including but not limited to hacking, phishing, or attempting to gain unauthorized access to other User accounts. 6. Intellectual Property** 6.1. The Scan Secure Pay App and all related materials, including but not limited to logos, trademarks, designs, software, and documentation, are the intellectual property of Scan Secure Limited and are protected by applicable intellectual property laws. 6.2. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Scan Secure Pay App and Services for your personal or business use. You shall not modify, copy, reproduce, distribute, or create derivative works based on the App or its contents without the prior written consent of the Company. 7. Privacy 7.1. Scan Secure Limited respects your privacy and handles your personal information in accordance with its Privacy Policy. By using the Scan Secure Pay App, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy. 8. Limitation of Liability** 8.1. To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to you use of the Platform.
